Travel / Carriage using a ticket shall be subject to conditions of carriage of Air Pegasus. Air Pegasus shall not be liable for any damages whatsoever arising out of (or) in any way connected with the use of this website (or) for any information, products and services other than carriage by air. While every effort has been made to ensure provision of correct and up to date information through this website, Air Pegasus shall not be liable for the accuracy of such information or any dispute that may arise in connection of or in relation to the accuracy of such information.
Due to operational reasons beyond our control, we regrets to inform that our flights till 31st October, 2016 are cancelled. We apologize for the inconvenience caused by the cancellation of the flights. We assure that the refund towards the reservation on the cancelled flights shall be processed from October 31st, 2016.
Changes are permitted to the itinerary / date of travel provided that the change must be made at least two (2) hours prior to the scheduled departure with a change fee of INR 1500 per passenger per sector for all fare types. Cancellations of Booking must be made at least two (2) hours prior to scheduled departure, with a cancellation fee of INR 1500 per Passenger per Sector for all fare types. Once a Confirmed Booking is made, the basic fare and all Air Pegasus surcharges paid are refundable, subject to cancellation rules. If the Passenger does not check in for a flight at least forty-five (45) minutes prior to its scheduled departure time, he will forfeit this total amount. The Passengers are entitled to a refund of the Airport charges and Government fees/taxes (if applicable). In case the Passenger desires, refunds of the residual value, the same shall be processed as given below: Bookings can be cancelled on the website, Call centre or Airport offices. For passengers opting for refund, refunds shall be processed through their respective credit card / debit card accounts. For Bookings made through Travel Agents cancellation will be processed through Respective Travel Agent of issue.
Air Pegasus would issue the refund either to the person named in the Booking, or to the person who has paid for the Booking, upon presentation of satisfactory proof. Proof of confirmation of cancellation of PNR indicated by an EV number with a password as sent by Air Pegasus by SMS / E-mail shall only be considered for refund.
Air Pegasus may refuse refund when application thereof is made after the expiry of the validity of the Booking.
All refunds will be made in INR, after deducting any applicable fee and/or charges.
This Process documents the compensation Process for flight delays, cancellation and denied boarding as mentioned in the DGCA CAR Section 3 Series M Part IV, dated 6thAugust 2010.

In the event of the flight being delayed for more than 24 hours, hotel accommodation would be arranged by Air Pegasus. The type of hotel is at Air Pegasus’s discretion and if the Guests choose to make their own arrangements, no reimbursements (for incidental expenses and otherwise) shall be made by Air Pegasus.Air Pegasus is not liable for any compensation if:
The delay occurs due to force major event, the impact of which lead to delay of the flight and which could not have been avoided even if all reasonable measures had been taken by Air Pegasus. For this purpose force majeure event shall mean, including, but without limitation, political instability, natural disaster, civil war, insurrection or riot, flood, explosion, government Regulations or order affecting the aircraft, strikes and labor disputes causing cessation slowdown or interruption or work, meteorological conditions, mechanical failures, commotion, embargoes, cancellation/delays clearly attributable to Air Traffic Control, security /safety risks or any other factor that is beyond the control of Air Pegasus.
Air Pegasus offers fares on a one-way basis for ease of purchase. All Air Pegasus fares are quoted in Indian Rupees (INR) only Fares are subject to change without notice.
Taxes, Fees and Other Charges are collected as applicable at the time of booking. Any change in the rates / amounts of taxes duties and other charges after the date of booking will become payable to Air Pegasus the difference in Taxes / Fees / Other Charges as applicable will be collected at the airports on the day of departure. The total fare amount charged by Air Pegasus includes: basic fare, taxes, surcharges payable to Air Pegasus, and any fee as prescribed by the government / airports. These fare components may undergo a change at any time without notice. An additional non-refundable convenience fee of Rs. 100 per passenger / transaction will apply for all online transactions. For passengers who request for duplicate print-outs of their ticket at the airport reservation counter, an additional fee of Rs. 50 per ticket will be applicable.
Air Pegasus requests that at the point of booking, the airline or its Travel Partner has to be provided with a contact number (valid mobile number)for each city in the Passengers' Itinerary including the applicable area codes for any assistance during contingencies.3.4 - Seating
Air Pegasus offers allotment of seats for travel at airport check-in counters. Due to Operational / Safety / Security reasons the seats so allotted can be re-assigned re-allotted at any time even after boarding the aircraft.
Passengers will be accepted for transportation only when a valid itinerary issued in accordance with Air Pegasus's regulations is presented at the check-in counters. All Passengers, including children, are advised to present valid photo identification and for Infants Valid Birth Certificates at the time of check-in. Passengers should carry the credit card / debit card, or a copy of the credit card / debit card duly signed by the card holder, at the time of check-in. The following are considered as valid photo identification: Valid passport; Valid driving license; Election photo ID; PAN card issued by the Income Tax Department; Photo ID issued by the employer (where the employer is a government entity or a reputed private sector organization); In case of children, their school photo ID cards or any other photo ID; For infants, their valid birth certificate. Passengers who cannot provide sufficient identification will be denied boarding. Passengers are advised to report for Check-in at least 2 hours prior to the schedule departure. Air Pegasus reserves the right to refuse acceptance of a Passengers who do not adhere to check-in timings. Check-in closes 45 minutes prior to the scheduled departure of the flight. The Booking would be considered a "No Show" and the Passenger shall be eligible for refund of Taxes and Government/Airport Fees only.
The boarding gate will be closed 20 minutes prior to the departure. The Passengers are required to be present at the boarding gate not later than the time specified by Air Pegasus when they check in.
Air Pegasus will not be liable for any loss or expenditure incurred by the passenger due to the failure of the passenger to comply with the check-in procedures.
Air Pegasus may refuse carriage of the Passenger or the Passenger's Baggage if, in the exercise of our reasonable discretion, we determine that:

Air Pegasus reserves the right to refuse carriage of such Baggage or such items found in the Baggage as stated below.
Air Pegasus allows free Checked Baggage up to 15kgs per adult and child (any Passenger above 2 yrs of age).A flat rate of INR 250 per kg per Sector would be charged towards excess Baggage.For international connecting passengers the travel is within 24 hrs excess baggage will be discounted to Rs.150/Kg on production of international travel air ticket copy to check in staff. Checked Baggage must have the Passenger's name or other personal identification affixed to it. Checked Baggage will, whenever possible, be carried on the same aircraft as the Passenger, unless Air Pegasus decides for safety, security or operational reasons, to carry it on an alternative flight. If the Checked Baggage is carried on a subsequent flight, Air Pegasus will deliver it to the Passenger. Situations may arise where transfer of cabin baggage to the baggage hold of the aircraft before takeoff will be necessitated in such cases the baggage will be tagged with an appropriate Limited Release Tag (LRT) and transferred to the hold. The baggage can be retrieved from the conveyer belts as done in the case of checked - in baggage.
Valuable and Fragile goods include, without limitation, Currency, Jewellery, silverware, electronic devices, medicines, perishable goods, computers, cameras, video equipment, negotiable papers, securities and/or other valuables, passports and other identification documents, title deeds, artifacts, manuscripts and the like. Passengers are advised not to check in Valuable and Fragile Goods as Baggage. If such items are checked in as Baggage, Passengers agree that they send for carriage of such items, at their own risk. Air Pegasus shall not accept any responsibility for such carriage.
Passengers may carry a maximum of one piece of Hand Baggage, of weight not exceeding 7.0 kg and not exceeding the following measurements in size Length - 55cm Width - 35cm Height - 25cm Additionally, a laptop (without bag) or a ladies' hand bag may be carried as Hand Baggage. Hand baggage of excessive weight or size, or of an offensive nature, will not be permitted on board. Subject to the prevalent applicable local laws and regulations, Passengers may take liquids on board in their Hand Baggage, subject to screening and security checks, and provided they meet the following restrictions:
Air Pegasus may refuse carriage as baggage of items described in 6.1 Air Pegasus may refuse to carry as baggage any item because of its size, shape, weight or character, unless advance arrangements for its carriage have been made with Air Pegasus. In case no advance intimation is received Air Pegasus may arrange carriage of such baggage by subsequent Air Pegasus flight. Air Pegasus may refuse to accept baggage as checked baggage unless it is Properly packed in suitcases or other suitable containers to ensure safe carriage with ordinary care in handling. Air Pegasus will not entertain any claims that arise out of or in connection with the refusal to carry baggage that is not in compliance with the present terms and conditions.
For reasons of safety and security, Air Pegasus may request the passenger to permit a search to be made of his or her person and his or her baggage, and may search or have searched the passenger's baggage in his or her absence, if the passenger is not available, for the purpose of determining whether he or she is in possession of or whether his or her baggage contains any item described in 6.1 or any arms or ammunitions which have not been presented to Carrier in accordance with 6.1. If the passenger is unwilling to comply with such request Carrier may refuse to carry the passenger and / or baggage.
Air Pegasus will not be responsible for, or have any liability in respect of, articles removed from the Passenger's Baggage by airport security personnel.
As required by applicable law, all Passengers will be subjected to a security screening prior to boarding the aircraft. Printed travel Itineraries will be checked at the time of entering the Terminal. Checked Baggage will be screened through an X-ray machine before check-in. Random physical checks are also carried out for Checked Baggage in addition to X-ray screening. As per security regulations, Passengers will be required to undergo personal frisking & their Hand Baggage X-rayed before entering the pre-boarding sterile area. Checked Baggage reconciliation is carried out through an internal matching system. Wherever it is not possible to have the Baggage reconciliation, the physical identification of the Checked Baggage by the Passengers will be carried out. Unidentified Baggage will not be loaded on to the aircraft. A secondary security check may also be carried out either near the boarding gate / step ladder before embarkation as and when stipulated by BCAS (Bureau of Civil Aviation Security of India).

Air Pegasus will endeavor to adhere to published schedules in effect on the date of travel. However, the schedules are subject to change without prior notice and Air Pegasus will not be liable for any loss incurred by passengers as a result of such changes. Air Pegasus will not be liable for any error or omission in publications of schedules, or in statements or representations made by employees, agents, or representatives of Air Pegasus, as to the dates or times of departure or arrival, or as to the operation of any flight.
At any time after a Booking has been made, Air Pegasus may change the schedules and/or cancel, terminate, divert, postpone, reschedule or delay any flight where it reasonably considers it to be justified by circumstances beyond its control, or for reasons of safety, or for commercial reasons. Circumstances beyond Air Pegasus's control can include, without limitation, weather, air traffic control, mechanical failures, acts of terrorism, acts of nature, force majeure, strikes, riots, wars, hostilities, disturbances, governmental regulations, orders, demands or requirements, shortages of critical manpower, parts or materials, labour unrest etc. If an Air Pegasus flight is cancelled, rescheduled or delayed for more than three hour, advanced by one hour or more, a Passenger shall have the right to choose a refund or reschedule; or re-booking onto an alternative Air Pegasus flight at no additional cost subject to availability as per the rules and regulations of Air Pegasus / government regulations. In the special case in which a subsequent portion of an Air Pegasus flight is cancelled while a Passenger is already in transit, such Passenger shall have the right to choose to remain at the transit station and to be re-booked onto an alternative Air Pegasus flight to the final destination at no additional cost subject to availability; or to remain at the transit station and accept a partial refund for the portion of the flight not completed; or to return to the point of origin and receive a refund as per Air Pegasus refund policy; or a credit for future travel on Air Pegasus; or re-booking onto an alternative Air Pegasus flight at no additional cost subject to availability. We strongly recommend all Passengers to provide correct phone and email address, to enable us to inform of flight delays or cancellations in unforeseen cases. Passengers who have not provided valid contact information at the time of Booking may not be entitled for any compensation. The operating airline would not have the obligation to pay compensation in cases where the cancellations and delays have been caused by an event(s) of force majeure i.e. extraordinary circumstance(s) beyond the control of the airline, the impact of which lead to the cancellation/delay of flight(s),and which could not have been avoided even if all reasonable measures had been taken by the airline. Such extraordinary circumstances may in particular, occur due to political instability, natural disaster, civil war, insurrection or riot, flood, explosion, government regulation or order affecting the aircraft, strikes and labour disputes causing cessation, slowdown or interruption of work or any other factors that are beyond the control of the airline. Additionally, airlines would also not be liable to pay any compensation in respect of cancellations and delays clearly attributable to Air Traffic Control (ATC), meteorological conditions, security risks, or any other causes that are beyond the control of the airline but which affect their ability to operate flights on schedule. Extraordinary circumstances should be deemed to exist where the impact of an air traffic management decision in relation to a particular aircraft or several aircraft on a particular day, gives rise to a long delay or delays, an overnight delay, or the cancellation of one or more flights by that aircraft, and which could not be avoided even though the airline concerned had taken all reasonable measures to avoid or overcome of the impact of the relevant factor and, therefore, the delays or cancellations.
As a policy, Air Pegasus does not overbook its flight. However, in case of overbooked situation arising due to unavoidable situations resulting in Passengers being denied boarding against their will, Air Pegasus shall provide a full refund of the reservation value or shift the Passenger's reservation to the next available flight. Air Pegasus reserves the right to deny boarding to any Passenger who is under the influence of alcohol or drugs, for health, safety or security reasons or in the absence of adequate travel documents and no compensation, as referred above shall be payable in such cases.
If, in Air Pegasus's reasonable opinion, a Passenger conducts himself/herself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fails to comply with any instructions of the crew, including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage/injury or threat of damage/injury to other Passengers or the crew, Air Pegasus may take such measures as it deems reasonably necessary to prevent continuation of such conduct, including restraint. Such Passenger may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed by him/her on board the aircraft. 9.2 - Payment Of Diversion Costs
If, as a result of conduct by a Passenger of the sort mentioned in Article 9.1 Air Pegasus decides, in the exercise of Air Pegasus's reasonable discretion, to divert the aircraft for the purpose of offloading that Passenger, the Passenger would be solely liable for all the costs whether directly or consequentially resulting from the diversion.
For safety reasons, Air Pegasus may forbid or limit operation aboard the aircraft of electronic equipment in accordance with the government regulations prevailing at that time. Such electronic equipment includes, but is not limited to cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and is permitted.
9.4 - No Smoking
Smoking is strictly prohibited on all Air Pegasus aircrafts. All lavatories are fitted with smoke detectors. Tampering with or disabling a smoke detector is an offence that is punishable under law. Passengers violating this clause are liable for prosecution upon arrival.
Air Pegasus offers a selection of complimentary snacks and beverages onboard on all Air flights. Passengers seated near an emergency exit will be briefed by the cabin crew regarding the emergency procedures. Passengers are required to pay special attention to these instructions. Please note that able bodied passengers aged above 15 years and below 60 years will be allocated seats at the emergency exit rows.
In the event of death or any other bodily injury suffered by a Passenger during the course of carriage by air, Air Pegasus's liability will be governed by the provisions of the Carriage by Air Act, 1972 with certain exceptions, adaptations, modifications etc. as notified by the Ministry of Civil Aviation, Government of India, and as amended from time to time. Notwithstanding the provisions of Article 16.3 above, in the event if the was caused by, or contributed to by, the negligence of the injured or deceased / injured Passenger, Air Pegasus will be exonerated wholly or partly from its liability as the case may be. Air Pegasus would not be responsible/liable for any illness, injury or disability, including death that is attributable to the Passenger's physical health condition or for the aggravation of such condition thereof. The contract of carriage, including these Terms & Conditions and exclusions or limits of liability, applies to our Travel Partners, employees and representatives to the same extent as they apply to Air Pegasus. The total amount recoverable from Air Pegasus and from such Travel Partners, employees, representatives and persons shall not exceed the amount of Air Pegasus's own liability, if any.
Liability for loss, delay or damage to Baggage is limited under the provisions of the Regulations and the rules contained in the Second Schedule of the Carriage by Air Act, 1972 with certain exceptions, adaptations, modifications etc. as notified by the Ministry of Civil Aviation, Government of India, and as amended from time to time. Air Pegasus's liability for damage to Baggage will be reduced by any negligence on part of the Passengers, which causes or contributes to the damage in accordance with applicable law. Air Pegasus will not be liable for damage to Hand Baggage unless such damage can be attributable to any form of negligence on the part of Air Pegaus or its staff. The Passenger shall be solely responsible for any damage caused by the Passenger's Baggage to other persons or property, including Air Pegasus's property and Air Pegasus will not be liable to any third person for any damage caused by the Passenger's Baggage. The solely liability in case of any claim by any third party shall lie entirely upon the passenger whole baggage has caused the damage to any third person or his property. Air Pegasus shall have no liability whatsoever for damage to articles not permitted to be contained in Checked Baggage as per the provisions of these Terms & Conditions (including, without limitation, fragile or perishable items, items having a special value, such as currency, jewellery, precious metals, computers, personal electronic devices, negotiable papers, securities, or other valuables, business documents, passports and other identification documents). Air Pegasus will not be liable for any damage arising from Air Pegasus's compliance with applicable laws or Government rules and regulations or from the Passengers' failure to comply with the same. Air Pegasus's liability for loss or damage to Baggage is limited to Rs 200 per kg with a maximum of Rs 3,000 only; however, Air Pegasus assumes no liability for fragile or perishable articles. The contract of carriage, including these Terms & Conditions and exclusions or limits of liability, applies to our Travel Partners, servants, employees and representatives to the same extent as apply to Air Pegasus. The total amount recoverable from Air Pegasus and from such Travel Partners, employees, representatives and persons shall not exceed the amount of Air Pegasus's own liability, if any.10.3 - Baggage Claims
By accepting the baggage at the time of delivery without any protest/complaint, the bearer of the baggage hereby acknowledges that the goods have been delivered in good condition and in accordance with the contract of carriage. Subsequent to the delivery of the baggage, no claims in relation to the baggage will be entertained by air Pegasus.
10.4 - Limitation
Any right to damages shall be extinguished if an action is not brought against Air Pegasus within three (3) years of the date of arrival at the destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. The method of calculating the period of limitation shall be determined by law of the court where the case is heard.
These Terms & Conditions shall be construed by, and governed in accordance with Indian Laws as amended from time to time.
